Notice of Privacy Practices
THIS NOTICE DESCRIBES HOW MEDICAL (OR PERSONAL) INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.
Introduction
HOM Los Angeles (“HOM”) provides housing services in Los Angeles County, California. HOM is not a “covered entity” under HIPAA. However, HOM does have access to—and at times must use—the minimum necessary elements of an individual’s health record or personal information to assist with the identification, procurement, and management of housing targeted for individuals and families participating in the Los Angeles County Homeless Services and Supportive Housing systems of care. We believe that this hybrid relationship merits our disclosure of how we manage these records and the information in them, even though HOM maintains no health or other privacy records of its own. Moreover, HOM executes all contracts and agreements in accordance with HIPAA, HUD, and LAHSA standards necessary to assign the responsibility for, and care of, health and other private information. These are called “Business Associate Contracts” or “Business Associate Agreements.” Accordingly, while we do not believe HOM is required to have a “Notice of Privacy Practices,” we think it is good practice and a responsibility we take seriously: maintaining your privacy in partnership with your health care, housing, and service providers.
Uses and Disclosures and Your Authorization
Healthcare Operations
Your health information may be used as necessary to support the day-to-day activities and management of HOM. For example, information on the services you received may be used to support budgeting and financial reporting, program evaluation, and quality improvement, or to assist with locating housing for you.
Housing Operations
In accordance with privacy rules and regulations connected with HUD-funded and LAHSA-administered housing programs, HOM conforms its policies and procedures to protect your privacy when coordinating with Continuum of Care (homeless assistance) and supportive service providers to help you obtain and maintain housing stability.
Law Enforcement
Your information may be disclosed to law enforcement agencies to support audits, inspections, investigations, or to comply with legally mandated reporting requirements.
Public Health Reporting
Your information may be disclosed to public health agencies as required by law. For example, we may be required to cooperate with the California Department of Public Health or the Los Angeles County Department of Public Health regarding reportable conditions.
Individual Rights
You have certain rights under federal privacy standards. These include:
- The right to request restrictions on the use and disclosure of your protected health information
- The right to receive confidential communications concerning your services
- The right to inspect and copy your protected health information (if available in a format that allows reproduction)
- The right to amend or submit corrections to your protected health information, if possible
- The right to receive an accounting of how and to whom your protected health information has been disclosed
- The right to receive a printed copy of this notice
You also have rights granted to you by the U.S. Department of Housing and Urban Development (HUD). The data management system known as the Homeless Management Information System (HMIS) used by LAHSA and the Los Angeles Continuum of Care (CoC) includes these rights, and your homeless services or supportive housing provider should explain them to you.
HOM Duties
HOM is required by law to maintain the privacy of your protected health information as a Business Associate of other covered entities, such as your health care or supportive service providers. While HOM is not a covered entity itself, we believe it is best practice to disclose how we manage privacy and maintain the security of personal and health-related information. In the event of a data breach involving unsecured protected health information, HOM will promptly notify the covered entity responsible for your health records and cooperate fully in any required reporting or remediation.
Right to Revise Privacy Practices
As permitted by law, HOM reserves the right to amend or modify these privacy practices. Such changes may be required by new federal, state, or local regulations. Upon request, HOM will provide the most recently revised version of this notice. Updated policies and practices will apply to all information maintained by HOM.
Requests to Inspect Protected Health Information
You may generally inspect or copy the protected health information that HOM maintains. Requests to inspect or copy must be submitted in writing. You may obtain a request form by contacting your Housing Specialist or Chief Programs Officer. Requests will be reviewed and approved unless there are legal or clinical reasons to deny access.
